Ogles and eight Republicans seek DOJ probe of Massachusetts officials

Townhall reports the request concerns a Catholic couple whose daughter was taken into state custody after alleged school counseling about gender transition.

Rep. Andy Ogles and eight Republican colleagues will ask Attorney General Todd Blanche to open a criminal investigation into whether Massachusetts officials conspired to deprive a Catholic couple of constitutional rights, Townhall reported Oct. 8. Townhall reports that Ogles also asked the Justice Department to conduct criminal investigations into other similar cases. American Principles Project Government Affairs Manager Caleb Pascoe said the group is backing him1.

The Supreme Court decided Mahmoud v. Taylor on June 27, 2025, by a 6-3 vote, after Montgomery County, Maryland, public schools added LGBTQ+-inclusive storybooks to the K-5 curriculum and rescinded the parental notice-and-opt-out policy. The Court held that the no-opt-out policy substantially interferes with the religious development of children and burdens free exercise under Wisconsin v. Yoder's parental-rights line2. Mahmoud concerned parents’ notice and opt-out requests for classroom instruction involving LGBTQ+-inclusive storybooks.

Ogles’s letter, Townhall reports, raises questions about whether Massachusetts officials violated federal law by taking custody of Joseph and Arlene Kutzko’s daughter, Sophie, because her parents objected to her gender transition. The Kutzkos allege the school counseled their daughter about transition without their knowledge, and Townhall reports they learned of it only after the Massachusetts Department of Children and Families took custody of her and accused them of abuse1.

Roughly two years: that is how long Joseph and Arlene Kutzko have been unable to contact their daughter, according to Rep. Andy Ogles1, 3. Townhall reports that, according to Ogles, the Kutzkos were fighting in court to stop Massachusetts from physically “transitioning” their daughter.

The investigation concerns the Northborough-Southborough school district, the Boston Globe reports. Its Student Privacy Policy Office says it will determine whether the district violated FERPA or PPRA. The district says it will cooperate fully, and Superintendent Gregory Martineau says it has already denied the allegations4. Ogles is asking the Justice Department to investigate whether Massachusetts officials violated the Kutzkos’ rights.
