HHS reportedly lets unborn babies be considered for foster care
The reported move comes as HHS counts about 55 foster homes for every 100 children in care, while states control key parts of the system.

The Department of Health and Human Services has said that unborn babies are now able to be considered for foster care, according to a Daily Wire exclusive1.
The Daily Wire headline describes the reported move as a “new lifeline” for expectant parents1.
Federal foster care runs on one rule: the child's health and safety is the paramount concern2.
Those rules direct that reasonable efforts be made to preserve and reunify families. They define parents as biological or adoptive parents or legal guardians, as determined by state law3. They also give any individual whose claim for benefits is denied or not acted on with reasonable promptness a fair hearing2.
In its fiscal 2027 budget justification, HHS says prevention and early intervention are central to its foster-care work and that it will continue to lead the Home for Every Child initiative to strengthen family-based care. Federal law already requires that reasonable efforts be made to preserve and reunify families2.
HHS’s FY 2027 budget says there are approximately 55 foster homes for every 100 children in care4. Each was a child in the womb.
What reaches a family now runs through the states. To draw federal foster-care payments, a state must have a plan approved by the HHS Secretary, and certain prevention services are offered at the option of the state2. That puts the choice with governors and state child-welfare agencies. A child in the womb is a child, and the family carrying that child deserves the system's help before birth, not only after a crisis.
