France's bill would criminalize speech on national identity
Franceinfo says the bill would raise penalties to three years in prison and €75,000 for elected officials or declared candidates.
Criminal penalties for political speech about national identity strip families of a voice in their own country's future. John Daniel Davidson warned on October 30 that "every European country turn hard toward authoritarianism" to suppress native populations and right-populist movements, citing a French Report post about Trappes Mayor Ali Rabeh1.
“every European country turn hard toward authoritarianism”
Franceinfo reports that ecologist deputies want France's 1881 press law to say that incitement to discrimination, hatred or violence can result from statements invoking the replacement of one population by another or the need for remigration2. The text reaches "remigration" as well as replacement, so it lands on vocabulary from the immigration debate that parents and voters use to argue about their country.
On France Inter, Trappes Mayor Ali Rabeh called for changing the law to make the “grand remplacement” theory illegal. The same day, ecologist deputies Sabrina Sebaihi and Steevy Gustave filed a bill in the National Assembly to do it2.
French Report's post that day went further, saying Rabeh announced that if the left won in 2027 it would penalize under the 1881 law the expression of the idea of "remplacement d’un prétendu peuple français blanc de souche3." The 2027 condition comes from that post; Franceinfo's account is of a bill already on the Assembly's desk.
Sebaihi told franceinfo the theory is "racist" and that it is not a point of view, and the bill's authors say it would strengthen the fight against speech inciting hatred and racist and xenophobic acts. Franceinfo ties the push to the Trappes attack that left one dead and seven injured2. Violence is already a crime, and this bill goes after a viewpoint by name.
Franceinfo reports that incitement to discrimination or hatred now carries one year in prison and a €45,000 fine2. Franceinfo reports that the bill would raise the penalty to three years in prison and a €75,000 fine for offenses committed by elected officials or people who have declared candidacy for public office.
Franceinfo reports that ecologist deputies filed the bill in the National Assembly on October 30.
French Report’s October 30 post made a left victory in 2027 the condition for the penalties it attributed to Ali Rabeh, writing, “en cas de victoire de la gauche en 2027.”3 That wording makes the election outcome the reported trigger, not a change scheduled to take effect on a stated date.
