Biden DOJ Let Activists Shape Its Agenda Against Parents’ Laws
Newly released records show activist groups met quarterly with Biden’s Civil Rights Division as it challenged state laws on transgender medicine, bathrooms and women’s sports.
The Justice Department owes parents equal enforcement of the law, but under President Joe Biden its Civil Rights Division let LGBTQ activist groups help set the agenda it turned against state laws protecting children and girls1.
Limiting or stopping whose legislation?
Activists had regular access as DOJ sued
Tyler O'Neil reports that the Civil Rights Division's LGBTQI+ Working Group convened quarterly stakeholder meetings with the American Civil Liberties Union, the Human Rights Campaign, Lambda Legal, the Southern Poverty Law Center and the National Women's Law Center. Those meetings ran while the department challenged state laws regarding transgender medicine, bathrooms and women's sports2.
America First Legal's separate records release found the same closeness: it says Clarke asked SPLC staff "if there are federal civil rights matters of concern that we should be tracking." America First Legal also says the groups were trusted to provide guidance to the department on transgender issues3.
Clarke blamed state protections for hostility
The Daily Signal reports that the documents record advocacy groups asking federal officials to discuss "what the federal government can do to limit or stop anti-trans legislation" and "strategic involvement by DOJ." The groups also sought discussion of litigation involving gender medicine and other policy priorities4.
The laws on that list keep puberty blockers, cross-sex hormones and sex-change procedures away from minors, and keep girls' teams for girls. A request for federal "strategic involvement" puts the government's power on one side of a fight that families had already won in their own legislatures.
Clarke linked concerns to Idaho filing
A sex-based restroom or locker-room rule is a parent's assurance that a daughter will not undress beside a boy at school. It protects her privacy and accuses no other child of anything.
Should federal lawyers working from an activist group's agenda decide who shares a changing room with a schoolgirl?
DOJ says activists no longer shape enforcement
The current Justice Department agrees about what happened. Spokeswoman Kiersten Pels told the Daily Signal that "under the Biden administration, far-left activist groups were given a seat at the table in shaping the Civil Rights Division's priorities." Pels said the division now "enforces federal civil rights laws as written, for every American equally, and its litigation and enforcement decisions are not shaped by outside activists4."
That is the right standard, and parents should hold the department to it. A spokeswoman's promise lasts only as long as the administration that makes it, and the quarterly meetings could return with the next one.
Candidates must reject activist-run policy
Every candidate asking for a family's vote this fall can be held to three yes-or-no questions. Would you restore standing meetings where activist groups submit agenda items for federal challenges to state laws protecting children, yes or no?
Will you keep girls' sports and girls' private spaces for girls, yes or no?
