Apple showed age checks can be private. Congress should protect kids online

Apple lists selfie checks in four countries, while Texas is the only U.S. state on its age-confirmation list, leaving Congress to protect families nationwide.

Protecting children online can be practical and private: Apple says its selfie age check “isn't accessible to anyone, not even Apple.”1 MacRumors reported that Apple released iOS 27.2 on October 26, 2026; its October 28 report says the update lets adults in supported regions prove their age without a credit card or government ID2.

Apple Support says the selfie “is analyzed using age-estimation models that run both on-device and on Private Cloud Compute.” Apple says the selfie remains inaccessible during analysis; “Once your age is confirmed, your selfie is deleted and isn't retained in any form.”1 If a phone can confirm adulthood in seconds without a card or a license, the excuse for leaving children unprotected online has run out.

Apple says the selfie is deleted

Apple says the selfie is never visible to anyone during analysis, Apple included. Users capture four angles of their face by moving their heads right, left, up and down1.

Apple says the age-estimation models run both on the device and on Private Cloud Compute. Once age is confirmed, Apple says the selfie is deleted1.

The check reaches 18-plus apps

Apple says a prompt may appear when a person creates an Apple Account, updates device software, changes certain safety settings, or tries to download or purchase apps rated 18+1.

After confirmation, Apple says the adult does not have to confirm again1. A person who declines can keep using the device, but must confirm before turning off certain safety settings3. That places the adult threshold at the app store, the point where a child's access to adult-rated apps is decided.

Apple names Texas as its only U.S. state

Apple's regional list says that where required by law, age-confirmation requirements apply in Australia, Brazil, Singapore, South Korea, the UK and, in the United States, Texas. Texas is the only U.S. state on that list4.

The selfie option is narrower: Apple lists it in Australia, Brazil, Singapore and the UK, and says debit and gift cards are not supported. Texas gets passport scanning instead, which Apple lists as available there4. Texas families are under the law, but the privacy-first method is not on offer there, and no other U.S. state is on the list at all.

Congress should protect children online

Apple's rules set the Child Account threshold at under 18 in Brazil and Texas. The same page sets it at under 13 in all other countries and regions, and lists no other U.S. state4.

Apple says that, depending on location, a minor may need to join a Family Sharing group with an adult who has confirmed their age to take certain actions on an Apple Account3. Congress should build a national standard on that model: parental authority, effective age safeguards and strict limits on retaining personal data. It should not freeze one company's technology into law, and it should not leave a child's protection to whichever state appears in a company's settings. A standard that works only in Texas protects one state's children.

Ask every member of Congress one question: will your bill protect a child in every state, yes or no?
