Angie Nixon put school secrecy ahead of Florida parents

Days before Florida's Senate vote, Nixon's 2022 amendment shows how she would put student consent ahead of parents' right to know.

Florida families should keep Angie Nixon out of the U.S. Senate, because she tried to write school secrecy into Florida law, and President Trump said at a Fort Myers rally on Oct. 23 that Nixon was the lead sponsor of a bill he said would let schools turn children transgender without parental consent. “Angie Nixon was the lead sponsor of a bill to let schools turn children, all of them, transgender if they want, without parental -- without parental consent,” Trump said. He told the same rally that Florida would send Ashley Moody to the Senate on Nov. 31.

On Oct. 31, Florida's Voice posted Trump pressing the charge again: “She was the lead sponsor of a bill to let schools turn children transgender without parental consent can you believe it.”2 Nixon’s amendment proposed allowing “personnel to withhold such information from a parent if the information would out a LGBTQ+ student without that student's consent”3. The Florida Senate’s summary says the law “prohibits school district from adopting procedures or student support forms that prohibit school district personnel from notifying parent about specified information or that encourage student to withhold from parent such information”. The summary also says the law “requires school districts to notify parents of healthcare services”4.

Nixon proposed withholding information from parents

On Feb. 18, 2022, then-state Rep. Angie Nixon offered an amendment to House Bill 1557, Florida's Parental Rights in Education bill. The amendment was approved for filing at 3:43 p.m. that afternoon3.

Florida law protects parental notification

Florida rejected that model. The House passed HB 1557 on Feb. 24, 2022, by a vote of 69 to 47, and the Senate passed it on March 8 by 22 to 17. The governor approved it on March 28, and it took effect July 1, 20224.

The law also requires districts to notify parents of health care services, and it gives a parent the right to sue a district for a declaratory judgment4.

That is the parental-notification rule Nixon's amendment would have carved open.

The case for Nixon's language rests on two words in her own text: “student's consent.”3 Put plainly, her answer to a child's privacy is a school employee who keeps the parents in the dark.

Parents carry the duty to protect, counsel and raise their children, and that duty does not pass to a guidance office because a child asks. If a child is wrestling with a question about sex and identity, who should walk with that child: a staff member bound to secrecy, or the mother and father who will be there long after the school year ends? Nixon's amendment picked the staff member.

Florida families should reject Nixon

Nixon is running for the U.S. Senate5. Florida already settled the question she raised, and it settled it for parents.

Should a school employee be allowed to keep information about a child from that child's parents, yes or no? Should a student's consent decide whether Mom and Dad are told, yes or no? Will she defend Florida's law that bars schools from encouraging children to keep secrets from their parents, yes or no?

Until she answers, families have her amendment, and it already answers all three.
